On 10/29/96, I contacted Mr. John Schmahl, operator of the Surface Roc
informed Mr. Schmahl that I had received his 10/23/96 letter, requesting
before the CMLRB regarding DMG 10/10/96 recalculation of financial war
that the Rules and Regulations of the CMLRB provided 60 days for the op
respond to DMG notice to increase the financial warranty. I stated that h
approach the CMLRB prior to the close of the 60 day period; however, st
procedure provided the 60 day period to reach an agreement on an appro
financial warranty without public hearing.

numerous. Mr. Schmahl stated that his disagreements were numerous to the point that
he was confused as to how to respond.. Mr. Schmahl indicated that he w s perplexed by
the requirements of government agencies which appeared excessive and nrealistic.
