Long <br />Division Direclar <br />This letter is in response to the two questions you forwarded to <br />the Division in your letter of November 30, 1993 regarding <br />scheduled reclamation work in the West Pit of the GEC mine. <br />Your first question involved the $18,500 estimated for drainage <br />work in the West Pit. Based upon the low bid which was accepted <br />for this project, it is apparent that the previous estimate was <br />low. However, the Division, Harrison-Western and the Corley <br />Company entered into the agreements outlining drainage <br />reconstruction with those funds. With those binding agreements in <br />place, the Division is obligated to use the Harrison-Western money <br />to reroute drainage around the existing sediment pond unless the <br />agreement between the Division and the Corley Company is modified <br />to allow for channel reconstruction as outlined in David Berry's <br />more recent design. <br />Implementation of either of the two plans mentioned above will <br />incur costs in excess of the $18,500 available from the Harrison- <br />Western settlement. If the first plan is revised to incorporate <br />larger design flows, it will almost certainly be more expensive <br />than the more recent plan for routing the channel through the <br />present sediment pond location. There are no funds for this work <br />available to the Division through Title V of SMCRA, which is the <br />source of the Division's budget.
