Coors Energy Company ("operator") desires to conduct a mining operation known as the <br />Keenesburg Strip Mine for the purpose of extracting coal (reclamation). <br />II. On January 24, 1996 the Division of Minerals and Geology ("The Division") notified the <br />operator that the (then) existing Permit for the Keenesburg Mine would expire on November <br />3, 1996. The operator submitted an application for permit renewal on May 3, 1996. <br />On July 3, 1997 the Division of Minerals and Geology ("the Division") proposed to approve <br />the operator's application for this permit, faced the amount of bond and dvected that this permit <br />be issued upon the filing with the Division of bond in the amount so fixed in form and <br />substance approved by We Division, and such bond has been so furnished. Approval of this <br />permit (renewal) was realized on August li, 1997; with (recognizing the operator's right of <br />successive renewal) an effective permit date of November 3, 1996. <br />III. On June 25, 1997 the Division made the following findings: <br />(a) The permit application is accurate and contains all information required under C.R.S., <br />34-33-101 er seq. and regulations promulgated thereunder and that all the requirements <br />of Article 33 of Title 34, C.R.S. ("such azticle") for the issue of a permit have been <br />complied with; <br />(b) The applicant has demonstrated that reclamation as required by such azticle can be <br />accomplished under the reclamation plan contained in the permit application; <br />
