RF.C'ITAi _S I. Coors Energy Company ("operator") desires to conduct a mining operation known as the Keenesburg Strip Mine for the purpose of extracting coal (reclamation). II. On January 24, 1996 the Division of Minerals and Geology ("The Division") notified the operator that the (then) existing Permit for the Keenesburg Mine would expire on November 3, 1996. The operator submitted an application for permit renewal on May 3, 1996. On July 3, 1997 the Division of Minerals and Geology ("the Division") proposed to approve the operator's application for this permit, faced the amount of bond and dvected that this permit be issued upon the filing with the Division of bond in the amount so fixed in form and substance approved by We Division, and such bond has been so furnished. Approval of this permit (renewal) was realized on August li, 1997; with (recognizing the operator's right of successive renewal) an effective permit date of November 3, 1996. III. On June 25, 1997 the Division made the following findings: (a) The permit application is accurate and contains all information required under C.R.S., 34-33-101 er seq. and regulations promulgated thereunder and that all the requirements of Article 33 of Title 34, C.R.S. ("such azticle") for the issue of a permit have been complied with; (b) The applicant has demonstrated that reclamation as required by such azticle can be accomplished under the reclamation plan contained in the permit application;
