Box 446 <br />Grand Junction, CO 81501 <br />Dear Mr. Nisley: <br />August 31, 1982 <br />In confirmation of our telephone discussion yesterday, Powderhorn <br />Coal Company would like to engage you for the appraisal of some 220 <br />acres of land over a portion of their Roadside mine. The land is <br />presently owned by Powder Mountain Ranch with Mr. Paul B. Alexander as <br />managing partner. Mr. Alexander has given us his verbal approval to <br />visit the surface as necessary to conduct your appraisal. Dale Fenwick, <br />Assistant General Manager, Powderhorn Coal Company will provide you with <br />maps which identify the areas to be appraised. Y.e will also arrange for <br />a guide if you require one and will provide you with any other assistance <br />that you request. <br />The surface to be appraised has been affected by subsidence. Our <br />reason for having the appraisal done is to assess the value of the land <br />prior to subsidence and any decrease in value as a consequence of the <br />subsidence. Your appraisal will be used in our continued discussions <br />with the property owner as we attempt to reach some equitable settlement <br />of his claim of damages. <br />Mr. Alexander has requested that he be allowed to discuss the land <br />and his plans for the land with you prior to your completion of the <br />appraisal. He has also agreed to provide to you the information that he <br />has in hand on water and water rights that are associated with the land. <br />We are agreeable to your having discussions with Mr. Alexander if you <br />feel that they are necessary or will be beneficial to your appraisal. <br />We are hoping that you can schedule this appraisal promptly and <br />bring it to conclusion as rapidly as is feasible. Please feel free to <br />call me if you have any questions regarding the appraisal.
