Dear Mr. Van Ryn:
The Division has reviewed the above referenced technical revision application
in consultation with the Colorado Division of Wildlife (DOW). We find that a
reduction of the 1000 stem per acre woody plant density standard for the
entire mine site is warranted based on a number of site specific factors.
These include the limited total disturbance (365 acres), limited contiguous
disturbance (311 acres), and the relatively long, narrow shape of the largest
disturbance area which has an average width of approximately 2,500 feet with
dense woody vegetation along the perimeter. The site is not a critical
habitat for any wildlife species, though numerous species including deer and
elk use the area at different times during the year.
Recent inspections have documented significant use of the reclaimed area by
elk and to a lesser extent by mule deer. Establishment of pockets of woody
cover along the reclaimed drainage and other areas in the central portion of
the major disturbance as attempted in the recent plantings should further
enhance the wildlife habitat value of the site.
We concur with the applicant's request thatpal
coon road. We also concur that a reduction in the standard is warranted for
the 1a~ger~is~ntcea, but it is our determination that a density standard
of would be prudent to insure that post-mining land use
objectives are met.
The following stipulation is necessary.
STIPULATION N0. 4:
THE WOODY PLANT DENSITY STANDARD FOR THE HAYDEN GULCH MINE IS REDUCED TO 0 FOR
THE 45 ACRE DISTURBANCE WEST OF COUNTY ROAD 53 AND IS SET AT 500 STEMS PER
ACRE FOR THE 311 ACRE DISTURBANCE EAST OF THE COUNTY ROAD.
