Long <br />Drnsron Direcbr <br />This letter is written accordance with Rule 2.05.5 of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining which requires that any proposed changes to the postmining <br />land use for a reclaimed coal mine be accompanied by comments from <br />the surface owner of record. As the surface owner of record for <br />the No. 1 Mine area of the North Thompson Creek Mines, operated by <br />MINREC, Inc. of Grand Junction, Colorado, your input is sought <br />regarding issues which have been raised regarding the postmining <br />land use at the referenced mine. <br />As you may recall, the original postmining land use of unimproved <br />rangeland was modified somewhat, with your approval, in 1992 to <br />allow the continued use of treatment ponds for the water which <br />began discharging from the mine in 1988. At the time that the mine <br />began discharging from the mine, the portals, which had been <br />backfilled during the reclamation of the mine, were dug out and <br />exposed to allow the operator to construct a controlled discharge <br />system. Since that time, the portal and air vent shaft have <br />remained exposed to allow the operator access to the discharge <br />sources. <br />The Division has recently discussed the present configuration of <br />the portal and vent shaft areas with the operator and has urged the <br />operator to backfill these areas to restore the approximate <br />original contour in accordance with the rules governing <br />reclamation. The operator presents the argument that the current <br />postmining land use includes water treatment and that it is <br />necessary to leave the portal and vent shaft accessible in order to <br />operate the water treatment system. MINREC, Inc. has, therefore, <br />proposed to the Division that the portal and vent shaft remain <br />
