Since Colorado is a primacy state the <br />information DRMS provides to the AVS system must be updated and or corrected by <br />DRMS, if a review is requested and information provided. <br />Currently DRMS shows that Westmoreland Coal Company as a "shazeholder" in <br />the Basin Resources, Inc. permit. I am requesting the DRMS make a determination of <br />ownership concerning this permit and report same to the AV S Office. <br />I <br />Enclosed herein please find the following: <br />a. CRF §701.5 Definitions <br />b. Januazy 11, 2001 letter from Kent Gorham to Cazl Johnston <br />c. Copies from the original permit application <br />d. Page 8 from the 2002 10-K filed by Westmoreland Coal Company with <br />the SEC <br />e. Pages from the 8K filed May 25, 2001 filed by Westmoreland Coal <br />Company with the SEC <br />f Pages from the U.S. Department of Labor Mine Safety and Health <br />Administration <br />Surface Mining Control and Reclamation Act (SMCRA) of 1977 were amended <br />and final rules became effective on Januazy 18, 2001. To paraphrase two sections <br />of these rules that can befound in the Federal Register/Volume 65 December 19, <br />2000 page 79621: Discussion took place concerning permit eligibility criteria. <br />
