Mark Rerr of <br />Landmark Reclamation. This letter confirms that Landmark <br />Reclamation and Energy Fuels Mining Company have entered into an <br />arrangement whereby the Raton Creek loadout, that is a part of our <br />permit for the Raton Creek Hine, is being made available to <br />Landmark Reclamation for its use in the loading of coal to be <br />produced from the Rimrock Strip Mine. Energy Fuels Mining Company <br />understands that, by entering into this arrangement with Landmark <br />Reclamation, the portion of our permit regarding the loadout <br />facility is coming out of temporary cessation into active status. <br />Further, Energy Fuels Mining Company understands that, pursuant to <br />the terms of our existing permit, it is responsible for the <br />reclamation of disturbances at the loadout until the loadout is <br />permitted by Landmark Reclamation or Rimrock Mining Company. <br />Please be advised, however, that as between Energy Fuels Mining <br />Gompany and Landmark Reclamation, our arrangement provides that <br />Landmark Reclamation will perform necessary reclamation <br />operations. <br />If you have any furthez questions regarding the arrangement <br />between Energy Fuels Mining company and Landmark Reclamation, <br />please contact me at the address above or if I am unavailable to <br />respond to your inquiries, please contact Mr. Timothy S.
