The Division received your letter of December 18, 1992 regarding
Basin Resources continued drilling operation past the specified
deadline of December 15, 1992 set forth in the Notice of Intent.
The letter was received in the office on December 21, 1992 and a
site inspection was conducted by the Division on December 22, 1992.
I spoke with Robin Byers of your firm to inform Richard Babnick of
Raton West that the inspection would be conducted on December 22,
1992. Ms. Byers stated that Richard Babnick was out of town for a
few days, and would not be able to attend the inspection. Under
the Colorado Rules and Regulations, Richard Babnick waived his
right to accompany the inspection. Mike Ossla of the Las Animas
County Planning and Land Use Office attended the inspection at the
request of Robin Byers.
I met Mike Ossla in Trinidad at 1:00 pm. Drill site NM-4 was
inspected, and there was no activity on site. The Division also
inspected the roads to determine if they were constructed according
to their permit. The NOI approved by the Division allows Basin
Resources to construct 100 linear feet of new road to access the
drill site. The Division found no evidence of road construction
beyond what was approved in the permit.
The inspection continued at the Basin Resources Office located in
the current Golden Eagle Mine. Ron Thompson was present at the
mine site. Mr. Thompson stated that drilling at site NM-4
continued through the 15th, 16th,: and 17th of December and
reclamation of the hole ended on the 18th of December. Based upon
this information, the Division issued notice of violation X-92-O1
(previously C-92-42) for failure to follow the NOI approved by the
Division. Please see the attached inspection report and the notice
of violation for clarification.
