Box 2679 <br />~~I I~~I~~~I~II~~ ~~~ <br />sss <br />Colorado Springs, Colorado 80901-2679 <br />Re: Mid-Term Review of Somerset Mine - File No. C-81-022 <br />Dear Mr. Holmes: <br />Attached is the Division's Mid-Term Review and Decision to require revisions <br />to the Somerset Mine, Permit No. C-81-022. The review was in fulfillment of <br />Rules 2.08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5), and 3.02.2(4). <br />The mid-term review primarily consisted of reviewing the permit application <br />stipulation responses, revisions, and any supplemental information, as well as <br />information from field inspections and past inspection reports. The main <br />purpose of the review was to identify any areas of the permit application that <br />will need to be revised or modified to ensure compliance and reflect the <br />current status of the mine. <br />The attached document contains our mid-term review, a rationale for requiring <br />any revisions to the application, timetables for submitting responses, a <br />summary of the status of stipulations, and the results of our performance bond <br />review. <br />Questions arose under the categories of Format and Supplemental Information, <br />Soils and Revegetation, Surface and Groundwater Hydrology, and Bonding. The <br />Division requires your response to these items by June 1, 1986. <br />The Division requests that Kaiser Coal Corporation submit appropriate <br />responses to our concerns raised in this letter as a separate technical <br />revision in accordance with Rule 2.08.4(5)(b) to include public participation <br />in our review process. This will require Kaiser Coal Corporation to publish <br />Notice of the Technical Revision once in a local newspaper and have a copy of <br />the technical revision application filed by the recorder at the nearest county <br />courthouse. Within 60 days after the filing of the complete application for a <br />technical revision, the Division will issue a proposed decision approving or <br />denying the application in whole or in part. The Division will send Kaiser a <br />written copy of the proposed decision and Kaiser will publish the decision <br />once in a local newspaper.
