F 101 <br />Durango, Colorado 81301 <br />Re: Delta County Gravel Pits <br />Dear Mr. Shuey: <br />After our "wake up call" involving the Ellison Gravel Pit, Delta County is now in the <br />process of reviewing all of the gravel pit operations in the County in light of the existing permits <br />and, if any noncompliance is noted, we are taking such action as is necessary to bring the <br />operation fully within compliance. Also based upon that experience, we felt it important to notify <br />you as to this process, some problems that we have discovered and the corrective action which <br />we are taking. The process involves not only the Board of County Commissioners, but our <br />Administrative Assistant Carolyn Clemens, our mapper Kevin Lawton, Bruce Bertram, the Road <br />Foremen, and ofcourse, the principal operator, John Timbreza. <br />Part of the process that we are engaged in is to use GPS to map the boundary lines, <br />disturbed areas, stockpiles, etc. at all of the pits where gravel operations are being conducted, <br />rectify discrepancies, and actually stake or otherwise locate for the benefit of the operator the <br />boundary lines oftl;e permitted areas, along with, as appropriate, file phasing required'oy tlic <br />mining plan. <br />Following is a progress report with respect to the pits that are presently under review: <br />Everything appears to be all right at the Fruitland Pit and the Pig Mesa Pit. <br />2. We are in the process of closing Dominguez, having received an approval letter <br />from BLM, and are in the final stages of that process. <br />We are also beginning the process to close the Lund Gravel Pit. <br />4.
