In fact, I did not say that there was regrading of the cutslope <br />because it did not occur. Rather, I indicated that the ditch below the cut slope of the <br />MSB was graded and maintained to remove materials that had fallen into the ditch <br />from the previous cut slope work above that location. With the frequent heavy rains, <br />this maintenance work was and is regularly needed. Please recognize that no <br />additional disturbance has occurred in this azea following your verbal direction during <br />your inspection on July 10, 1997, and particularly following the issuance of NOV CV- <br />97-010, and prior to the approval of Minor Revision No. 220. I am not sure why this <br />miscommunication, occurred although it is quite possible that I simply did not make <br />myself cleaz. In any event, we might have corrected this issue prior to the issuance of <br />the report if the report, had been prepared at the mine at the conclusion of the <br />inspection where we could have reviewed it together for accuracy. <br />The second item in the inspection report that needs clarification is the statement that, <br />"No new work has been conducted at the east of the MSB, where an engineered fill is <br />proposed for expansion of the MSB". Please recognize that no work (new or <br />otherwise) had been conducted in this area prior to the approval of Minor Revision <br />No. 220. <br />I believe that if you review aerial and/or inspection photography during this period, <br />you will find that that no additional disturbance has occurred on the west side of the <br />
