Dept. of Natural Resources
Dear Mr. Shelton:
Enclosed please find the Best-Way Paving Co. _reclamation plan. Best-Way is
also requesting a minor change in the reclamation plan previously approved
by the commission.
When the plan was initially submitted, it was anticipated that D-watering
could be pumped directly into the irrigation canal paralleling the north line
of the property. This could not be accomplished as the ditch company could
not take any additional water. When mining of phase one began it became
obvious that any D-watering would have to be pumped to the northeast corner
of the property where the water would be pumped into the city storm sewer and
carried to the Poudre river. Phase one has been mined to just above the water
table. Due to the expense of piping and pumping the water from phase one,
then cutting it off to D-water phase two and again progressively expanding the
pumping system as other phases are devleoped, it does not appear practical.
We would request that we be allowed to complete excavation of phase one follow-
ing phase fourteen as this is a much more practical sequence and should not
make any appreciable difference in reclamation of the property.
Thank you for your cooperation.
Very truly yours,
Thomas A. Connell
Vice-President, General Counsel
TAC/cnd
Enclosure
