This parcel has received approval as a sand and gravel mine to be reclaimed For water storage under DMG 112 Reclamation Permit No. M-2001-085. The Seller has executed an agreement with the City to remove the mineral resources from this historic mine, to provide a clay liner in accordance to DMG's requirements and to deliver the reclaimed parcel to the City for water storage. During the DMG and Adams County permitting processes, the Seller has appazently sought approval of different access routes to the mine site from both permitting authorities. Now the Seller and the City aze anxious for mining activity to begin but understand that the mining operator does not have an access route to the site that has been approved by both the DMG and Adams County. On September 6, 2002, the Seller was informed by telephone by your office that approval of an alternate access route to the 124`s Estates site from 120a' Avenue could occur only by way of a pemut amendment, often a three to four month process. Unfortunately for the City, the Seller was less than prudent with their timing for the alternative access routes request, although this in no way excuses their error, it would certainly create an unexpected delay for Brighton. The City is counting on delivery in 2003 of the water storage capacity that this mining site represents; we are exploring ways to shorten this permit modification process.
