I was able to confirm an active fox den in <br />the slash pile southeast of the tailings pond. <br />The slash pile does not seem to compromise the stability of <br />the tailings pond, human safety or mine operations. The mixture of <br />mineral soil to slash is such that it is not a fire hazard. The <br />slash pile is not even located in a visual corridor which would <br />influence the area's aesthetic values. <br />The preferred alternative would be to leave the fox den and <br />slash pile for wildlife habitat. This may serve as an excellent <br />example of how mining and wildlife can coexist. The presence of <br />foxes is not an issue, with respect to mine operations. A state <br />law, 33-6-128, prohibits the destruction of dens or nests unless <br />the residents are causing damage. <br />If human safety or any other issues regarding the slash pile <br />are a concern, a second alternative would be to remove the slash <br />pile after the young foxes have dispersed. September 30th should <br />be a safe date for removal of the slash pile, if necessary. <br />I am sending a copy of this letter to the mill manager. You <br />and he have my recommendations and can negotiate any amendments to <br />the permit.
