Last week, a water commissioner from our office performed a field <br />inspection at the above referenced gravel pit, for purposes of this office <br />signing off on a proposed water court decree (92CW1061. During the <br />inspection, Mae Cunning noticed an existing pond on the site. <br />2. One of the questions Hal Simpson had during discussions concerning <br />the proposed decree, was if there was a backfill bond, should the gravel pit <br />operator quit operations. I subsequently reviewed the file (82-112) and <br />noticed only a`535,000 bond for sloping, topsoil, and reseeding. We have <br />~~jg~~ modified the proposed water court decree to include language concerning <br />the operators responsibility or their successors, in backfilling the pond <br />should the augmentation plan fail. <br />3. This memo is being forwarded to you should a modification in the <br />current bond be needed in your opinion.
