STATE OF COLORADO
DIVISION OF MINERALS AND GEOLOGY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, CO 80203
Phone: (303) 866-3567
FAX: (303)832-8106
MEMORANDUM
To: David Leavenworth, Division of Purchasing
From: Dave Bucknam, Division of Minerals & Geology
Date: September 30, 1992
Re: Blue Flame Project (Bid # RN-MINES-302)
OF"COQ
R~
Nc~ o
« ~
~ /Bib ~
Ray Ramer
Governor
Michael B. LOng
Division Director
At yesterday's bid opening for the Blue Flame Project, Mr. Robert Lobato of
Tulsa, Oklahoma was identified as the apparent low bidkier for the work with a
bid of $22,500. I request that the project not be awarded to Mr. Lobato based
upon his failure to meet the condition in our bid specifications that makes
awards to the lowest responsive and responsible bidder. Mr. Lobato is a
principal in the firm of L & L Energy which had its permit to mine coal at this
project site revoked and its reclamation bond forfeited. As such, he is
blocked by federal and state regulations from receiving a permit to mine coal
anywhere in the country. His history of non-performance of requirements under
the Division of Minerals and Geology's regulatory program leads me to conclude
that he is not a 'responsible" bidder.
To avoid similar situations in the future, the Division of Minerals and Geology
will be adding the following clarification of what constitutes a "responsible"
bidder to all new bid documents for reclamation work:
Responsible bidder - A company or individual who has had a Division of
Minerals and Geology permit revoked or bond forfeited or who hoe been
removed from a reclamation project for failure to perform will not be
considered a responsible bidder. A company or individual who has
outstanding unresolved problems of a construction or financial nature
with the Division may not be considered a responsible bidder; the
Division will evaluate these latter situations on a case-by-case basis.
I hope this resolves both the current issue regarding the Blue Flame Project
and future similar situations. Please contact me if you need further
information.
cc: Bob Nondorf
