Banta, <br />Divisign Director <br />As we discussed, I have compiled a summary of the history of the GEC West <br />Pit. This information is in the GEC files and inspection reports. <br />In October of 1982, GEC Inc. and Harrison - Western made an agreement in which <br />Harrison-Western would establish portals in the west pit for access to Newlin <br />Creek coal. As a result of this agreement, Harrison-Western assumed liability <br />per reclamation of the West Pit. A 5143,000 bond was posted to cover this <br />liability. <br />The Colorado Mined Land Reclamation Board revoked GEC's permit on February 23, <br />1984 and forfeited the bond on October 25, 1984. Harrison-Western's West Pit <br />bond was not included in the forfeiture, apparently because backfilling of the <br />West Pit .was in progress or complete at that time. <br />On February 12, 1986 the Division released 60% of Harrison-Western's West Pit <br />bond, following an application for Phase I bond release. The Division found <br />that backfilling and grading had been successfully accomplished. <br />Harrison-Western reduced their bond to 557,200 in March of 1986. So, the <br />Division currently holds this bond for the West Pit even though there is no <br />permit for the operation. <br />The Division conducted inspections of the West Pit regularly, including <br />quarterly inspection through 1989. The last inspection report is for an <br />inspection done in November, 1989. <br />Harrison-Western's last work on site was some erosion control work done in <br />1987 or 1988 by Len Diggler. <br />Apparently, Don Bozarth is responsible for keeping track of the bond money for <br />Harrison-Western.
