Yes, the Mined Land <br />Reclamation Division approved the movement of Newlin Creek waste, as specified in the <br />September 1981 document, by the minor revision process. The use of a minor revision to <br />evaluate, and approve or deny, the movement of coal mine waste from one permitted site to <br />another, was deemed proper by the Division in 1981, and is not inconsistent with current <br />practice. The minor revision process includes a public notice procedure, and we have no reason <br />to believe that this procedure was not followed. <br />With regard to your questions about a "plan to extinguish the gob fire," it appears that this issue <br />was addressed by the Division in accordance with the applicable rules and standards in the early <br />1980's. There are a large number of documents which address this issue, and the plans <br />involved both state and federal authorities. <br />We have expended considerable effort in attempting to answer your questions about events <br />which date back nearly 13 years. As previously stated, these matters have been extensively <br />addressed in both the administrative and judicial arenas. We can only assume that all pertinent <br />details, especially such matters as legal right-to-enter provisions would have been brought <br />forward during the previous proceedings. <br />While we have devoted many staff hours to researching your questions thoroughly, we cannot <br />guarantee that each and every historic document has been referenced.
