BANTA, Dlreetor <br />June 29, 1988 <br />Mrs. Jenni Naff <br />Mr. Ted Naff <br />P. 0 Box 266 <br />Nucla, CO 81424 <br />RE: Peabody Coal Company Permit Revision #2 <br />(Nucla East area); Permit C-81-008 <br />Dear Mr and Mrs Naff: <br />As discussed over the telephone on Monday, June 27, 1988 with Mrs. Naff, your <br />objection letter of June 18, 1988 pertains to the proposed Nucla East area <br />addressed in a revision application submitted to the Division by Peabody Coal <br />Company. As we further discussed over the telephone, the Division was <br />uncertain if your objection letter pertained to this revision application or <br />to the permit renewal application that the Division was proposing to approve. <br />You had previously, on February 11, 1988, submitted an objection letter to the <br />permit renewal application from which the Division requested some additional <br />information in our letters of February 25 and March 17, 1988. Since we did <br />not receive any responses from you concerning the additional information, we <br />sent you a letter on Mdy 18, 1988 specifying "...the Division has rendered a <br />proposed decision to approve this renewal application subject to one <br />stipulation. This decision will become final after the required public notice <br />and public comment period unless specific requests are made fora hearing <br />before the governing Colorado Mined Land Reclamation Board." We were <br />uncertain if your letter of June 18, ]988 was sent to us in response to our <br />May 18, 1988 letter with enclosed proposed decision and findings of compliance <br />document. During our telephone conversation, Mrs. Naff specified that your <br />June 18th letter is objecting to the proposed mine located just west of Nucla; <br />that is, the revision application for the proposed Nucla East area. <br />With this clarification of your objection letter, the Division will hold a <br />hearing in the town of Nucla to allow residents to voice their concerns. Our <br />governing rules and regulations require that we wait until the end of the <br />public comment period before we are allowed to hold an informal conference or <br />hearing. The public comment period ends on or about July 18, 1988 and the <br />Division must hold the informal conference prior to September 16, 1988.
