F .-. <br />r ~'a.: ~. d ~t ~ <br />SEP 2 3 1JP3 <br /> <br />There has been some confusion in the past as to who Western Fuels of <br />the Deserado Mine must contact regarding use of the public lands in <br />the coal mine permit area. ide acknowledge that your Division has the <br />lead on all actions within the mine permit area with BLM concurrence <br />on those actions. The confusion, however, seems to center around the <br />right-of-ways within the mine permit. We were informed during a com- <br />pliance inspection between David Harper of my staff and Tom Caruso of <br />ldestern Fuels, that your division has verbally consented to waive a <br />revegetation stipulation which is required in the BLM load-out loop <br />right-of-way C-31639. To date we have not been contacted by your <br />Division in regard to this change. <br />While we acknowledge that *II.P.D maintains lead in revisions and changes <br />to the mine permit, the BLP1 is t}ie only agency that is authorized to <br />change, modify or amend a right-of-way grant and therein lies the <br />confusion. The above cited instance is a case where we do not feel the <br />right-of-caay stipulation should be waived. As such, the reported consent <br />to drop the revegetation stipulation is unse[tling. <br />I feel that this situation is indicitive of a breakdown in BLM and <br />MLRD coordination. A breakdown of this nature could be very costly <br />towards our joint resource management efforts. Therefore, I suggest <br />we schedule a meeting in the near future and redefine our roles and <br />responsibilities relative to the Deserado 'tine. <br />Save Energy and You Serve America! <br />
