Bassett, Esq. Respondent <br />was represented by John Merrill, Esq. <br />Cheryl A. Linden of the Attorney General's Office presented a <br />stipulation for the Board's signature concerning Mr. Gorman's <br />anticipated testimony of facts which are confidential information. <br />It was accepted by the Board and a signed copy returned to the <br />Attorney General. <br />FINDINGS OF FACT: <br />1. Petitioner is protesting the 1994 actual value of the <br />subject property, an operating coal mine known as the 20 Mile Mine <br />or the Foidel Creek Mine. <br />3. Colorado statutes specifically address the valuation of <br />producing coal mines for the purposes of ad valorem taxation, and <br />the Property Tax Administrator has promulgated valuation procedures <br />and has performed studies to ascertain several factors that are <br />used in the formula. <br />1 <br />
