Upon review of this notice, the Division has the following comments. <br />The plan to revegetate only the portal face up areas during cessation would be <br />in violation of the C.M.L.R.B. Rules and Regulations. Rule 4.05.6(8)(8) <br />requires all sediment pond embankments to be re vegetated immediately after <br />construction. Rule 4.06.3(2) requires protection of topsoil stockpiles during <br />the first growing season after placement. Rule 4.03.2(3)(c)(ii) requires <br />temporary stabilization of road cuts. New Castle Energy should be aware that <br />failure to comply with these Regulations may result in enforcement action by <br />the Division. <br />The submitted notice indicates New Castle Energy's awareness that monitoring <br />and maintenance activities must be continued through the cessation of <br />operations.
