Hart & Associates <br />December 13, 2004 <br />Ms. Erica Crosby <br />Colorado Division of Minerals and Geology - <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 DEC .~ 5 2604 <br />RE: DMG file # M-97-097, East Rigden Pit'/ <br />S~t'f 1AS OF RPta'~/ <br />Deaz Erica: , <br />Recently, Bill McDowell of the Flatiron Companies (Flatiron) provided me with a copy of <br />your letter dated October 15, 2004 to Eric Reckentine in which you raised some questions about <br />the status of mining and the long-term reclamation at Lafazge's East Rigden sand and gravel pit. <br />As we discussed last Friday, December l Od' the purpose of this letter is to respond to your <br />October 15th letter to Eric. <br />In your letter you referenced a September 22, 20041etter that the Colorado Division of <br />Minerals and Geology ("Division") received from the Office of the State Engineer (OSE) <br />regazding the East Rigden Pit Substitute Supply Plan. In part, the OSE's letter stated that <br />"Mining has been completed at the East Rigden site and construction of a clay liner is <br />proceeding in the southeast portion of the property. " In addition, your letter goes on to say that <br />"Please be aware that Lafarge must revise the East Rigden reclamation plan if a clay-lined <br />reservoir is anticipated " <br />As you know, the OSE's September 22nd letter was prepared in response to an August 26, <br />20041etter from Richazd Raines of the Applegate Group, Inc. regazding the renewal of the <br />substitute supply plan (SSP) for the East Rigden pit on behalf of Lafarge West, Inc. (Lafazge). <br />Richazd's SSP renewal letter stated in part that, "Mining is complete at the East Rigden site. In <br />addition, mined material is no longer conveyed from the adjacent Resource Recovery Site, M-99- <br />078, to be processed at the East Rigden facility. The existing stockpiles will be sold over the next <br />two years. Since the previous renewal, the exposed acreage has also decreased. Construction of <br />a clay reservoir liner is proceeding in the southeast portion of the property. " While it is true <br />that Lafazge's mining is complete at the East Rigden site, overall mining is not yet complete and <br />likely will not be completed for several years to come. <br />zzss Meadow Avenue <br />PO.
