Dept. of Natural Resources Re: GEX Colorado, Inc., - Cameo and Roadside D4ines Dear Rick: As we discussed, I enclose a copy of an April 7, 1981 letter from Donald A. Crane, Esq., Regional Director of the United States Department of the Interior, Office of Surface bfining. It per- tains to GEX's applications currently under review on the Cameo and Roadside mines. A4r. Crane observes that GEX has claimed con- fidential treatment on a considerable portion of the material pro- vided in connection with such applications. He adds that the GEX claim appears to go beyond the scope of confidentiality provided in the Surface Mining Control and Reclamation Act, which of course is mirrored in the Colorado Surface Coal 1,9ining Reclamation Act. Mr. Crane has requested that we forward to you his determination that such information cannot be considered confidential. He also asks that GEX consent to "declassify" such information. Perhaps someone at GEX will meet with Keith Kirk, who is men- tioned in Mr. Crane's letter, and attempt to eliminate differences. If they are unable to resolve the differences between GEX and OSM then please be in touch with me so that we may pursue the matter further. Best regards.
