A. May 4, 1994-Colorado West Leasing (CWL) informs the Division
of Minerals and Geology (DMG) that he does not intend to move
certain previously stockpiled topsoil. Also, CWL does not
intend to prepare the ground for drill seeding by raking rock.
CWL will not drill seed where rock is present.
B. May 10, 1994-DMG informs CWL that in the course of its grading
operations at the East Pit and Chen's Hill, it lost topsoil
and overburden that should have been salvaged and stockpiled.
Also, DMG informs CWL that compaction of fill was not
occurring according to the plan. CWL is notified that job
progress reports were not submitted as required to date.
C. May 16, 1994-CWL responds to DMG's letter by copying their
lawyer.
D. May 31, 1994-DMG is informed by the Project Observer that CWL
is placing topsoil in areas contrary to the requirements of
the amendment to the bid.
E. June 16, 1994-CWL argues that the State is not entitled to
reduce the project time for work reductions without the
contractors consent. Also, CWL requests a time extension.
F. July 19, 1995-CWL begins questionable billing also threats of
court action.
G. Argumentative and repeated failure to follow the direction of
the project manager such as the following issues which were
addressed in the DMG letter of August 26, 1994:
1. Asking for payment for being required to install
water bars needed due to CWL's deliberate damage of an
environmentally sensitive area specifically referenced,
in the amendment to the bid, to be not disturbed.
2. Trying to bill twice for work which was done
incorrectly the first time such as the slope grade of the
