May 4, 1994-Colorado West Leasing (CWL) informs the Division <br />of Minerals and Geology (DMG) that he does not intend to move <br />certain previously stockpiled topsoil. Also, CWL does not <br />intend to prepare the ground for drill seeding by raking rock. <br />CWL will not drill seed where rock is present. <br />B. May 10, 1994-DMG informs CWL that in the course of its grading <br />operations at the East Pit and Chen's Hill, it lost topsoil <br />and overburden that should have been salvaged and stockpiled. <br />Also, DMG informs CWL that compaction of fill was not <br />occurring according to the plan. CWL is notified that job <br />progress reports were not submitted as required to date. <br />C. May 16, 1994-CWL responds to DMG's letter by copying their <br />lawyer. <br />D. May 31, 1994-DMG is informed by the Project Observer that CWL <br />is placing topsoil in areas contrary to the requirements of <br />the amendment to the bid. <br />E. June 16, 1994-CWL argues that the State is not entitled to <br />reduce the project time for work reductions without the <br />contractors consent. Also, CWL requests a time extension. <br />F. July 19, 1995-CWL begins questionable billing also threats of <br />court action. <br />G. Argumentative and repeated failure to follow the direction of <br />the project manager such as the following issues which were <br />addressed in the DMG letter of August 26, 1994: <br />1. Asking for payment for being required to install <br />water bars needed due to CWL's deliberate damage of an <br />environmentally sensitive area specifically referenced, <br />in the amendment to the bid, to be not disturbed. <br />2. Trying to bill twice for work which was done <br />incorrectly the first time such as the slope grade of the <br />
