Enclosed is the complete list of all stipulations included in the
West Elk Mine, Mountain Coal Company permit following the 1991(92)
Permit Renewal. Following each stipulation is a summary of how or
why the stipulation was complied with, terminated, forgiven, or
remains in active or future status if the reasons are known. This
compilation is a result of research into all correspondence
regarding stipulations since the permit was issued. The
stipulations included in the permit issuance in 1981 are not
included in this document, because a majority of them have been
resolved and were never entered into the Division data base. Those
stipulations that were not complied with have since been renumbered
and are included in the attached list. (Please see a chart
included in the Stipulation Tracking File folder dated July 2,
1992, which details the 1981 stipulations.)
A few of the stipulations have no summary because I could not
locate the information in the Division files. Hopefully, with the
cooperation of the operator, we can document what was provided to
the Division in order to terminate, comply with, or forgive the
stipulation. Those stipulations are as follows:
* Stipulation 32 (Stip. 7 from PR 2 and 4)
* Stipulation 12 (Stip. 13 from PR 4 of Stip. 41 from the
original permit issuance)
* Stipulation 6 (From the 1986 Permit Renewal)
* Stipulations 14, 15, 16 (Stips. 15, 16, 17 from PR 4)
* Stipulation 20 (From the 1986 Permit Renewal)
* Stipulation 36 (From Matt Hayes memo dated 3-5-90)

June 1, 1992, which asks for more information related to the above
stipulations.
