As you may be <br />aware, the State and the Contractor are currently in a claims <br />dispute. The Contractor is currently in the process of appealing <br />his construction claims to the Executive Director and is requesting <br />an amount of money greater than the bond amount. We cannot predict <br />the outcome and it would be inappropriate for me to speculate on <br />how much bond money remains while this claim is being considered by <br />the Executive Director. <br />During construction, the Project Manager measured the project <br />slopes with an abney level. On December 15, 1994 the Division <br />surveyed the project site using a Zeiss-Elta 3 survey instrument. <br />No major slope areas were steeper than 3:1 (Horizontal:Vertical). <br />Sincerely, <br />/ James B.
