Box 576 <br />Somerset, Colorado 81434 <br />RE: Surface Owner Notification - Hawk's Nest Mine Reclamation <br />Dear htr. Pecharich: <br />The Mined Land Reclamation Division will be performing final reclamation work <br />at the Hawk's Nest Mine beginning in August of this year. The operator, <br />Western Slope Carbon, Inc., failed to meet regulatory requirements for an <br />extended period of time. This failure to comply resulted inrevocation of the <br />mining permit and forfeiture of the reclamation performance bond being held by <br />the Division. As part of the reclamation process, the Division needs to <br />provide notification of the impending reclamation work to all surface owners <br />of the area to be reclaimed. Information in the original Hawk's Nest Mine <br />Permit application indicated that a majority of the surface area to be <br />reclaimed was owned by U.S. Steel and leased to Western Slope Carbon, lnc. As <br />U.S. Steel's assets were acquired by Kaiser in recent years, it appears that <br />Kaiser Coal Corporation or one of the newly created Kaiser entities resulting <br />from bankruptcy reorganization now owns the surface to be reclaimed. <br />In an effort to ensure that appropriate individuals within Kaiser have been <br />adequately notified, the Division is sending this letter to you and to <br />John Talfy of Kaiser Coal Corporation in Raton, New Mexico. If you feel that <br />other individuals within the Kaiser organization should be notified, or if you <br />have more accurate information regarding the present surface owner(s) of the <br />U.S. Steel surface leases in the area occupied by the Hawk's Nest Mine surface <br />disturbances, please contact the Division as soon as possible so that the <br />appropriate entities and/or individuals can be properly notified. <br />Please contact me at (303) 866-3567 if you have any questions. <br />Sincerely, <br />r <br />Tom D.
