As we understand, your question was whether the road which exists between the <br />GEC mine site gate and the perimeter of the GEC Mine pit, should be permitted by Energy Fuels as an <br />Energy Fuels mine road. You have requested information illuminating the regulatory basis for our <br />decision, documented by letter dated November 28, 1995, which indicated that the road in question is <br />associated with the GEC Mine, not the Southfield Mine. The letter indicates our determination that the <br />Southfield Mine has no permitting or regulatory responsibility for the road in question. <br />The GEC Mine permit was revoked and all bonds forfeited many yeazs ago. Our agency has long ago <br />determined that there were no viable options available to pursue additional monies from any GEC <br />Mine related entities. Therefore, the GEC Mine is an abandoned site as defined by our Rule 1.04(1). <br />Various reclamation activities have occurred through our AML program, using the previously forfeited <br />bonds, pursuant to the procedures allowed by C.R.S. 34-33-133. All available forfeiture monies have <br />been expended. The road in question was constructed as a part of the GEC reclamation plan, and the <br />construction was conducted using the bond monies derived through the GEC Mine permit revocation <br />and bond forfeiture process, and for the purpose of providing access for ourselves and various local <br />users, to and through the site. The adjacent Southfield Mine had no control over the manner in which <br />the road was constructed or reconstructed. <br />Recently we have become concerned that additional work needs to be conducted to improve the <br />reclamation of the GEC Mine. We are, therefore, pursuing additional money through the State <br />legislative budget process to conduct additional, necessary reclamation at the GEC Mine. This <br />additional pursuit of money is allowed by C.R.S. 34-33-133. <br />
