Lorhhexl Execmne Director Mkhael B Long D~~„~n~ Di,er~or The Division of Minerals and Geology hereby issues notice, in accodance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on August 24, 1998, an application to revise coal mining operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. The revision was submitted by Bowie Resources Limited. All review and comment periods as provided in the .Act and the Regulations initiate from this date of filing. This Technical Revision proposes to add a shaft and ventilation fan to the mine facilities. Th shaft and fan would be located on the uppermost facilities bench. The underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. The permit area is further described as follows: Portions of Sections 2, 3, 4, 9, 10, 11, 14, 15, and l6, Township 13 South, Range 90 West of the 6th P.M. The above-mentioned tracts of land are shown on USES 7.5 minute Quadrangle map of Bowie. Because the above referenced technical revision application would incorporate additional lands into thpermit area or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your agency's evaluation of the potential for impacts to threatened or endangered species of plantar animals, or wildlife species otherwise protected by federal law. In order for us to approve this revision, we are required to makes finding that "the activities would not affect the continued existence of endangered or threatened speciemr result in the destruction or adverse modification of thei critical habitats as determined under the Endangered Species Act of 1973...." We request your review and recommendation pursuant to this finding. Applicable sections of the revision application are enclosed. Please advise us if you require additional information.
