Lorhhexl <br />Execmne Director <br />Mkhael B Long <br />D~~„~n~ Di,er~or <br />The Division of Minerals and Geology hereby issues notice, in accodance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on August 24, 1998, an application to revise coal mining <br />operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. The revision was <br />submitted by Bowie Resources Limited. All review and comment periods as provided in the .Act and the <br />Regulations initiate from this date of filing. <br />This Technical Revision proposes to add a shaft and ventilation fan to the mine facilities. Th shaft and fan would <br />be located on the uppermost facilities bench. <br />The underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. <br />The permit area is further described as follows: <br />Portions of Sections 2, 3, 4, 9, 10, 11, 14, 15, and l6, Township 13 South, Range 90 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USES 7.5 minute Quadrangle map of Bowie. <br />Because the above referenced technical revision application would incorporate additional lands into thpermit area <br />or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your <br />agency's evaluation of the potential for impacts to threatened or endangered species of plantar animals, or wildlife <br />species otherwise protected by federal law. <br />In order for us to approve this revision, we are required to makes finding that "the activities would not affect the <br />continued existence of endangered or threatened speciemr result in the destruction or adverse modification of thei <br />critical habitats as determined under the Endangered Species Act of 1973...." We request your review and <br />recommendation pursuant to this finding. Applicable sections of the revision application are enclosed. Please <br />advise us if you require additional information. <br />A copy of the technical revision application is availablefor public inspection at the Delta County Courthouse, 5th <br />& Palmer, Delta, CO 81416, and at the Division office.
