I am also enclosing a copy of a letter from Mike <br />Chapman on behalf of the Animas Valley Water and Ditch Company and its objections as well <br />as my response to him of August 11, 2004, including the application for the water right on the <br />well. <br />Pursuant to the pre-hearing conference, it is my understanding that there will no longer be <br />a hearing on this application at the DMG in Denver at the September Commission board meeting <br />inasmuch as Mr. Greve has withdrawn his objection to the permit. <br />Upon receipt of the formal reclamation plan from Mike Fitzgerald of Ecosphere setting <br />forth the reclamation requirements of the La Plata County Colnmissioncrs' Rescluticn to obtain <br />a special use permit for the gravel pit, I will forward a copy of that to you as well as to Mr. Greve. <br />Very truly~yours~, <br />~!" ` ` "" <br />_/G.~' <br />Frank J.
