Items are addressed in the same sequence put forth in that <br />letter. <br />5. Re: Proposed sampling plan for material pertinent to the Designated Mining <br />Operation (DMO) status determination. <br />MRV will commit to the submittal (in the form of a Technical Revision) of a <br />comprehensive sampling and analysis plan to evaluate the site's DMO status as <br />pertaining to the acid generating potential (AGP) of vein and wall rock materials. <br />MRV requests that the Cash Mine AGP Analysis Plan (Technical Revision) be <br />submitted to the Division not later than 60-days following conditional approval of <br />Amendment No. 2, with sampling commencing coincident with approval of said <br />Technical Revision. The sampling period would be carried out over atwelve-month <br />period; interpretation of results and presentation of mitigating measures, if warranted, <br />would be completed not later than six-months thereafter. <br />MRV envisions that the Technical Revision will encompass representative sampling <br />of vein and wall rock materials (to include both hanging wall and footwall), utilization <br />of Acid Base Accounting (ABA) analytical procedures, and interpretation of data <br />utilizing recognized methodologies. If such materials are found to exhibit acid <br />generating potential, MRV reserves the right to assess the degree of acid generating <br />potential within the context of proposed operations, and appropriately incorporate <br />materials management procedures and/or other measures to preclude DMO status. <br />In the event significant AGP is indicated, non-DMO status would be contingent on <br />satisfactorily demonstrating to the Division that such materials can be adequately <br />managed or isolated from producing adverse environmental affects over the long- <br />term. <br />
