Morton, <br />Robert J. Stevens, and Larry L. Stevens and is more particulazly described as follows: <br />136.83 acres of land situated in the Northeast Quarter (NEl/4) of Section Twelve (12), Township <br />One (1) North, Range Sixty-seven (67)West of the 6th P.M, County of Weld, State of Colorado, <br />included as a part of Lot B of Recorded Exemption No: 1469-12-1-RE 1525, as per the map recorded <br />January 6, 1994 in Book 1421 under Reception No. 2367922, being a part of the Southeast Quarter <br />(SEl/4) of Section One (1) and the Northeast Quarter (NEl/4) of Section Twelve (12), both being in <br />Township One (1) North, Range Sixty-seven (67) West of the 6th P.M., County of Weld, State of <br />Colorado. <br />This letter is intended to be our official notice to yon that_Lafarge West. Inc. has no -egal J <br />right to enter this property and no operational agreement to mine the properly. <br />As the owner of this property, we believe and maintain that the Opfion given to Mobile Premix <br />Concrete, Inc. dated May 19, 1999 is terminated by operation of the language and provisions <br />therein and the absence of an operational Gravel Lease. <br />We have no objection to Lafazge West, Inc. applying for and including this property in the <br />permit applicafion, provided however, that the we as owners of said property are held harmless <br />and indemnified in writing by LaFazge West, Inc. from any obligation or liability inherent in the <br />approval process and provided that the property may be withdrawn by the owners at any time in <br />the future without liability in the event that an operational gravel lease agreement is not obtained <br />between the parties. ~' <br />Sincerely, ~ ~ 2j ~ S ,7 , i L Z ~ <br />Marg et V.
