DIUIStCS'v <br />Dear Mr. Mills: <br />The Office of Surface Mining Reclamation and Enforcement (OSMRE) is <br />currently in the process of developing a i4ining Plan Decision Document for <br />the approval of mining additional coal (Little Middle Creek Tract) on the <br />Eckman Park mine area. <br />An item has surfaced which needs to be resolved in order for the paperwork <br />associated with the Mining Plan approval to proceed. This item concerns the <br />unpaid "Windy Gap" contribution for this operation. This contribution is <br />based on the projected annual depletion of xater from the Upper Colorado <br />River Basin caused by the addition of the Little Middle Creek Mining Tract. <br />The projected annual depletion for this additional area is 2.78 acre-feet <br />which amounts to $41.70. The contribution of the $41.70 to the conservation <br />fund will offset the impacts of the project to Federally listed endangered <br />fish species.
