Lonp <br />Division Director <br />Pursuant to Title 34, Article 35, Paragraph 3, of the Colorado Revised <br />Statutes, the Division of Minerals and Geology hereby issues notice that on <br />August 20, 1993, a technical revision application for a permit to conduct coal <br />mining operations by Mountain Coal Company, P.0. Box 591, Somerset, Colorado <br />81434, was deemed complete for the purposes of filing. All reviews and <br />comment periods as provided in the Act and Regulations promulgated thereunder <br />initiate from this day of filing. <br />The applicant proposes to revise underground coal mining operations at the <br />West Elk Mine. The technical revision is to construct a crushed coal <br />stacktube and reclaim system. Three ponds, MB-2, MB-3, and MB-6, will be <br />redesigned and relocated to accomodate the location of the stacktube and coal <br />pile. Mountain Coal Company currently has water storage rights on MB-2 and <br />MB-3. Also, access roads in this area will be relocated to provide access to <br />this area. This area has been previously disturbed by operations at West Elk <br />Mine. <br />The permit area of the West Elk Mine is described as follows: <br />Sections 9, 10, 15, 16, 17, 18, 19, 20, 21, 22, 26, 27, 28, <br />29, 30 and 34, Township 13 South, Range 90 West of the 6th P.M., <br />in Gunnison County. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map <br />of Somerset. <br />Because the above referenced technical revision application might alter <br />previously approved permit conditions or mitigation measures, we are <br />requesting your agency's evaluation of the proposal as it relates to fish and <br />wildlife considerations, including potential impacts to threatened or <br />endangered species. <br />
