Long, <br />Division Director <br />It is my understanding that Kiowa County desires one permit for the 24.6 acre <br />Barnett Pit. I have reviewed our files and have verified that Kiowa County <br />has inadvertently permitted a 15 acre permit (M-91-074) and a 9.8 acre 110(2) <br />permit (M-83-088), which are adjacent to each other. The Division was unaware <br />of your desire to consolidate the two permit areas when the 112 application <br />was submitted in June, 1991. <br />We suggest that Kiowa County submit a permit amendment to permit No. M-91-074 <br />to include the entire 24.6 acre tract. We will then terminate Permit No. <br />M-83-088. I have enclosed application forms for your use. There will be no <br />application fee required due to our misunderstanding. We request that you <br />complete ':he application form and revise the legal description and mining and <br />reclamation plan maps to include the entire 24.6 acres.
