She has also determined that Kaisers 2003 vegetation sampling data indicate that the mine's
reclaimed areas have achieved Year 9 revegetation success.
She mentions in her memo, however, that, "the (Chimney Rock) permit text does not define the vegetation
sampling methodology to be used to determine reclamation success". It thus seems that Kaiser Ventures will
need to submit a technical revision to the Chimney Rock permit (per Rules 2.05.4(2)(e)(vi) and 4.15.7] to
incorporate the vegetation sampling methodology that Janet reviewed and found adequate.
Since Janet is out until Friday, would you mind touching base with the folks at Greystone (the consultants
that prepared the bond release app) and see if revising the permit (to incorporate the sampling methodology into
the permit as required by the Rules) is what they believe the next step is?
Thanks,
Dan
~]~

/2 vas < vv. .z, ~ S~/3/ ~ 4' .
2S ~c~PM i.~~
5/3/2004
