Cattany, Director Division of naclamation, <br />Colorado Division of Reclamation Mining & Safety ~ Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />(303) 866-3567 ' <br />FAX (303) 832-8106 <br />Dear Mr. Cattany: <br />This letter constitutes notice that the Costilla County Committee for <br />Environmental Soundness (CES) objects to the proposed Permit Amendment, DRMS <br />Permit No. M-88-11~., filed by Battle Mountain Gold on October 2006. <br />We do not believe that the Mined Land Reclamation Board has the authority to <br />grant Battle Mountain Gold water rights to irrigate the property formerly known as the <br />Shalom Ranch. The MLRB cannot grant a change of industrial/mining water to <br />agriculture use. <br />The CES contests the assertion by Battle Mountain Gold that the West Pit water <br />is now ofpre-mining quality. We feaz contamination of the farmland, which is adjacent <br />to the school and the Town of San Luis. <br />Further, the Committee for Environmental Soundness objects to: <br />1. .A proposal to close the water treatment facility located near the Rito Seco Creek <br />on the Battle Mountain Gold (BMG) property. <br />2. A proposal to irrigate the BMG property, formerly known as the Shalom Ranch, <br />with water that should have been processed through the water treatment plant <br />which is currently in operation. <br />3.
