Name of structure to be augmented: Red Creek Cistern,
located in the NW1/4SW1/4NW1/4NE1/4 of Section 1, Township 17
South, Range 68 West of the 6th.P.M. in Fremont County, Colorado.
This structure also diverts water rights adjudicated in Case W-3553
in this Court at a rate of 24.66 gallons per minute. Applicants do
not seek to increase the adjudicated pumping rate, but do seek to
use water from such structure for purposes described hereinafter.
Red Creek Cistern is located in the Red Creek drainage, which is
tributary to lower Beaver Creek, which in turn is tributary to the
Arkansas River.
3. Each share of stock ownership represents a pro-rata interest
in the Independence Pass Transmountain Diversion System which
diverts water from the headwaters of the Roaring Fork River and its
tributaries in Pitkin County, Colorado for storage in the Twin
Lakes Reservoirs in Southern Lake County, Colorado. Twin Lakes
Shares consist of direct flow and storage rights for water diverted
from another basin which is available for 100 percent consumptive
use and reuse and is available for augmentation. The water rights
producing the pro-rata interest owned by the Applicants are
described as follows:
(1) Decree:
(a) Case No. 3082, District Court, Garfield
County, August 25, 1936;
a.
