RE: Adequacy Review for Baca County Pit Number 8 Conversion of a 110 Permit to 1 12, Permit
Number M-77-485: Response to Submittal Received September 10 2001
Dear Mr. Crane:
The Division of Minerals and Geology has completed its review of your response to adequacy questions for
the Baca County Pit Number 7 conversion from ] 10 construction materials permit to a 1 l2 construction
materials permit. The application was received on May 18, 2001 and determined tD be complete for technical
review on June 18, 2001. An Adequacy Letter was sent to you on August 14, 2001, and this letter addresses
items that require clarification in your response received September 10, 2001. The decision date for this
application is September 17, 2001. Please be advised that if you aze unable to satisfactorily address the
concerns identified in this review prior to the decision date, it will be your responsibility to request an
extension of the review period. If there are outstanding issues that have not been adequately addressed prior
to the end of the review period, and no extension has been requested, [he Division will deny this application.
The following items require further infonnation or clarification:
Permit Application, PaEe 2, Item 9, Location Information: The Township has been changed from
the correct location on the original application (T 34 S) to Township 34 North on this revision. Please
re-submit this page with the correct township and range directions. Additionally, in the quarter
section the box for NW and SW have been checked. The instructions ask that one box be checked. It
is this inspectors understanding that the permit is for the SW '/a of Section 8 so the box for SW
should be checked and NW should be left blank. In the Quarter Quarter section both NW and SW
have been checked. The instructions ask that one box be checked. As the permit is apparently for the
entire SW '/a, there is no need to check either of these blanks. A marked-up copy is provided in the
interest of clarification. Please correct this sheet and re-submit it.
6.4.1 Exhibit A Le2a1 Description: The legal description submitted in the original submittal as
Exhibit A, appeazs to represent the area being proposed to be mined. The ttew Exhibit A received in
this office on September 10, 2001 describes an 80 acre parcel. The application indicates the permit
area to be 160 acres. Please indicate in a revised submittal what area you wish to permit. This area
must agree with the various maps and with Exhibit N, Source of Legal Right to Enter. Please call me
and I will be happy to assist in the description.. A marked-up copy is provided in the interest of
clarification. Please correct this sheet and re-submit it. I[ appears that the correct description would
be: the Southwest '/a of Section 8, Township 34 South, Range 48 West of the Sixth Principle
Meridian, consisting of approximately 160 acres.
