D~~ision Dueaor Dear Party: Colorado Division of Minerals and Geology (DMG) is recommending approval of the amendment application AM-01 of the Lemoine Pit, Permit No. M-79-140, submitted by Delta County. This recommendation is based on the finding by DMG that the applicant has demonstrated compliance with the requirements of Section 34-32.5-715(4) of the Colorado Land Reclamation Act for the Extraction of Construction Materials (C.R.S. 34-32.5-101, et sea.). Due to the recommendation for approval of an application for which objections have been received, DMG has scheduled the matter of a decision on the application for a Formal Public Hearing before the Mined Land Reclamation Board (Board). The Formal Public Hearing has been scheduled to be held during the October 21. 1998 Board meetine. The meeting will be held in Victor, Colorado, and the Hearing will begin at 9:00 a.m., or as soon thereafter as the matter can be heard. The location of the meeting will be the Elks Lodge, at the intersection of 3rd and Diamond. Pursuant to Construction Materials Rule 2.7.1, DMG has scheduled aPre-hearing Conference to be held prior to the Formal Public Hearing, for the purpose of identifying the parties to the Formal Public Hearing, and to identify the issues to be heard by the Board at the Formal Public Hearing. The Pre-hearine Conference is scheduled 1o be held on Tuesday. October 13. 1998. at 1 00 o.m.. at the meeting room in the Hotchkiss Town Hall The last day that written materials, submitted in response to the Informal Conference, were to be received by DMG was September 24, 1998. Please be reminded that no additional issues may be raised at either the Pre-hearing Conference or the Formal Public Hearing. I am enclosing several documents for your information.
