~C
February 23, 2006
Mr. James Stark
Environmental Protection Specialist
Colorado Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, CO 80203
Re:
Dear Mr. Stark:

RECEIVED
FEB 2 7 2006
Division of Ltinera~~• s
~,~,,,,,
Oxbow Mining, LLC (OMLLC) has received the Division's February 22, 2006 Adequacy
review for MR-76 (via facsimile). The purpose of this letter is to provide a response to
the Division's concerns.
1. Hydrology Monitoring Plan -- PAP Volume 12, Exhibit 2.05-E7 provides the
information regarding the overall OMLLC Hydrologic Monitoring Plan. The H-10 Well
and the B-Seam Well described in the Plan will be monitored to determine B-Seam
water levels. Pumped water volumes will be measured utilizing installed water flow
meters. `lJltimafely, this information will be included in the AHR's.
2.'~''' The,Gtilify borehole will have a removable cap installed to provide temporary
sealing. The tiorehole's location is adjacent to the Hubbard fan facility. Both the surface
fansite facility and underground borehole (and adjacent fan shaft) are on a weekly
inspection schedule to satisfy MSHA requirements.
3. OMLLC has reviewed the Division's reclamation cost estimate. Regarding the
two rib boreholes, one borehole has already been plugged and sealed with concrete,
and the second borehole has been plugged and partially sealed with concrete. The plan
is to complete the sealing of the second rib borehole when the site is safely accessible
by a concrete truck. For this reason, we believe the Division's cost estimate should
include only the two water transfer boreholes and the utility borehole and not the two rib
boreholes.
Please contact me at (970) 929-5806 if you have questions or require further
information.
Sincerely,
,_
..~.
Environmental Coordfhatdr '" - -
Xd:' ''' Jim' cooper (OMLLC)
"' Files -

3737 Hwy 133 P.O.
