Box 46667 <br />Denver, CO 80201-6667 <br />Re: McClane Canyon Mine (Permit No. C-1480-004) <br />Technical Revision Application No. 15 (TR-15) <br />RN-6 Permit Updates <br />Dear Mr. Johnston: <br />The Division of Minerals and Geology (the Division) hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on March 31, 2006, an application to revise coal mining operations at the <br />McClane Canyon Mine was considered complete for the purposes of filing. The revision was submitted by CAM Mining LLC. <br />All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />This revision proposes modifications and updates to various sections of the approved permit, in response to concerns identified <br />by the Division in the preliminary adequacy review of Permit Renewal No. 6 (RN-6). The application includes an updated <br />and expanded section addressing potential effects of the operation to threatened and endangered (T&E) species <br />(enclosed). The Division is requesting that you prepare a biological assessment (B.A.) based on the information in the <br />enclosure, and, if necessary, coordinate with the U.S. Fish and Wildlife Service (USFWS) to obtain their concurrence. <br />Please provide the B.A., and your recommendation regarding the TR-15 and RN-6 proposed decisions within 45 days of <br />receipt of this letter. Please address the recommendation letter to my attention, at the letterhead address. <br />The underground coal mining operation is on land located approximately 20 miles north of Loma, Colorado. The permit area is <br />further described as follows: <br />Portions of Sections 15, 16, 21, 22, 27, and 28, T7S, R102W, 6th PM, all in Gaffield County. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Howard Canyon & Harvey Canyon. <br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete. A[ the time of <br />publication of this notice, the applicant is additionally required to place a copy of this application at the Mesa County Clerk and <br />Recorder, P.O. Box 20,000, Grand Junction, CO 81501, and a[ [he Division offices in Denver and Grand Junction.
