Permit Amendment M-0 Henderson Mine and Mill, Permit No. M-1977-34~tnr Resource Trustee
By a letter dated January 28, 2003, the Clear Creek Economic Development Corporation provided
comments in favor of the approval of certain specific changes in post mining land use at the
Henderson Mine. These changes will allow the surface warehouse and maintenance shops, the
main office building and attached eating and shower facilities, as well as the sewage and potable
water systems to remain in the post mining setting to be put to industrial/commercial use. The
Division of Minerals and Geology (DMG) and the Mined Land Reclamation Board (NLRB)
appreciate the Corporation's efforts and input to the pending reclamation permit amendment. I am
pleased to tell you that DMG will be recommending approval of the proposed post mining land use
changes at the mine site as supported by the Corporation's letter.
In addition to a number of letters of support for the proposed permit amendment, the DMG also
received two letters objecting to certain aspects of Henderson's proposals. All of the objections
relate to the proposed changes to the reclamation plan at the Grand County Henderson Mil]
facilities, and will have no affect on the proposal to allow certain buildings to remain at the mine
site in Clear Creek County. Since objections to the permit amendment have been received, the
DMG has scheduled apre-hearing conference in accordance with the NLRB rules and regulations.
Enclosed with this memo is the conference notice and summary of issues. As being on record in
support of the permit amendment, the Clear Creek Economic Development Corporation is welcome
to participate in the pre-hearing conference. If the remaining issues are not resolved to the
satisfaction of the objecting parties at the pre-hearing conference, a hearing before the NLRB will
be necessary. The Corporation would be provided notice of such a hearing. The DMG does not
believe that the issues raised by the objectors to the amendment will affect the eventual approval of
the changes in post mining land use for which the Corporation has expressed its support.
