After consideration of this <br />request, vie would liloe to request a further modification in light of the <br />NPDES permit decision issued by Colorado Department of Health. <br />Sun Coal Company requests to monitor only the permitted NPDES point <br />discharges, as stipulated by Colorado Department of Health, with the <br />understanding Sun Coal will analyze for the parameters listed in their <br />original request. After consideration of the proposed program, we do not <br />consider monitoring the Yampa or groundwater to be technically or <br />scientifically justified. We envision the permitted discharge points will <br />be used for compliance purposes and will provide an accurate base to <br />assess if sediment contribution from the reclaimed area will provide the <br />technical justification to grant bond release. <br />Sun Coal Company, when final bond release is considered, will use the <br />Modified USLE to estimate pre disturbance sediment yields and will be <br />cot~ared to the sediment yields estimated during the bonding period. <br />If you have questions or comments regarding this request, please do not <br />hesitate to call. <br />~-_ <br />Senior <br />cc.
