Virginia <br />Gunnison, CO 81230 <br />Re: Hawks Nest E b W Coal Mine Permit Renewal - Permit No. C-81-016 <br />Dear Sir or Madam: <br />Pursuant to Rule 2.07.4(3)(d) of the regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, you are hereby notified that the Division <br />is proposing to deny an application for renewal of an existing permit held by <br />Western Slope Carbon, Inc. for the Hawks Nest E b W Mine. This decision is <br />based on findings by the Division that Western Slope Carbon, Inc. is not <br />meeting the terms and conditions of the existing permit, that the operation is <br />not in compliance with the Act and Regulations, and that information requested <br />by the Division has not been provided. <br />The underground mining operation is located in portions of sections 1, 2, 3, <br />4, 9, 10, 11, 12 of T13S, R90W of the 6th P.M. in Gunnison County. The coal <br />processing waste disposal site associated with this operation is located in <br />portion of S 1/2 SW 1/4 NE 1/4 of Section 28, T14S, R92W of the 6th P.M. in <br />Delta County. <br />A copy of the proposed decision is available at the Clerk and Recorder's <br />Office in your county.
