Lang <br />Division Direcwr <br />Asa result of discussions held on July 2, 1992 in the Division's olrfices with <br />Alana Scott, Anne Baldrige, and Dean Massey, as representatives of <br />Battle Mountain Gold (BMG), in regard to the five (5) conditions prgposed by <br />the Division for approval of TR-O8, it is the Division's understanding that <br />BMG will accept conditions 2 through 5 as outlined in the Division's letter of <br />April 9, 1993. As a result of points raised by BMG during the meeting, <br />however, it was agreed that some modification was to be made in Condition 1. <br />The following revision of Condition 1 is consequently proposed: <br />BMG will maintain and employ the approved ground water monitoring <br />network according to the approved monitoring plan until it is <br />demonstrated to the Division's satisfaction during the final <br />reclamation phase of the tailings facility and collection pond that <br />water flow from the tailings facility to the collection pond has <br />ceased to be measurable for a period of 1 year, and that ground <br />water below the tailings facility and collection pond is of such <br />quality that no remediation efforts are required. Should the <br />Division determine that evidence of any significant contamination <br />of ground water from leaks or discharges from mine facilities has <br />been detected during this period by monitoring or other means, BMG <br />will be responsible for instituting and completing the remediation <br />procedures approved in the Permit. <br />
