On 12/22/94 the AVS system recommendation for the Twin Pines renewal was ISSn oirec~or
On that day I requested OSM to provide their recommendation. OSM will respond
within three (3) working days. You need to request two (2) more AVS checks, one
before you publish your proposed decision and another before your issue the permit.
As per your request, on 12/22/94 I called Mr. Larry White [phone], Engineer
with Twin Pines. I informed Mr. White that in permit section 2.03.4 Identification of
Interests, revised 12/19/94, several names are listed without stating their title or
relationship to the applicant. Specific names that I mentioned were Ruth Vendetti and
Giuliano & Sons Coal Company (Luois Giuliano, Irene Giuliano, and Diana G. Boleski).
I also stated that information required by Rule 2.03.4(2)(b) and (c) was not listed. I also
stated that the permit page was confusing in that it was organized in an outline that did
not conform to the outline of Rule 2.03.4, as such, abbreviated information given in
paragraphs 1(d) and 1(e) of permit section 2.03.4 is meaningless.
Section 2.03.4 of the permit needs following corrections:
1. Ensure outline format conforms with outline utilized by Rule 2.03.4 or avoid using
abbreviated information;
2. State title, function or relationship of Ruth Vendetti and three individuals listed
under Giuliano & Sons Coal Company;
3. State who is the applicant's resident agent (Rule 2.03.4(2)(b)) and who will pay
the abandoned mine land reclamation fee (Rule 2.03.4(2)(c);
4. Within AVS, there is a Twin Pines Coal Company associated with this permit,
please state what/who Twin Pines Coal Company is.
5. The officers of Falcon Energy, Inc. are listed as being Chris Reed, Jack Barton,
Dale Rose, and James Mezo. There are no officers listed for Twin Pines
Investment limited partnership. Please state who are officers/directors of Twin
Pines Investment Ltd., if there are none, please state this as well.
