GO 8018) <br />Pnone (0001 873800 <br /> <br />oeT 1 G 1~8~ <br />MINED .K(~,: <br />RECLAMATION JIVISIOiJ <br />Dear David: <br />-27 <br />1 Area Exemotion for Toosoil <br />As you are aware, the field issued Minor Revision 89-45 involved <br />sedimentation control of Topsoil Stockpile 3-3 which is located to the <br />southwest of Pond K at Mine 2. We agreed that if sediment was generated <br />from the area, it would be controlled by the existing conditions. The minor <br />revision was approved with the understanding that Colorado Yampa Coal <br />Company would submit a technical revision to designate the area as a small <br />area exemption. This technical revision serves to satisfy that requirement. <br />The area of Topsoil Stockpile 3-3 meets both of the criteria <br />established within Rule 4.05.2(3). Existing field conditions would treat <br />any of the sediment generated from the site as required by Rule <br />4.05.2(3)(a). Specifically, the area surrounding the stockpile is well <br />vegetated. Also, a sump exists on the downslope side of the stockpile <br />which would further serve to trap surface flow. Finally, a stock water pond <br />is situated downslope from the general area and all of the small area is <br />tributary to that stock pond. Concerning Rule 4.05.2(3)(b), the area for <br />which the exemptiuri is requested is small in comparison to the overall <br />disturbed area. This is demonstrated on the enclosed map, Map 9A, <br />Hydrologic Features and Sediment Control. <br />Based upon this discussion, Colorado Yampa Coal Company believes this <br />area meets the applicable criteria for a small area exemption. <br />The pages which have been updated for this technical revision are <br />Permit Renewal 780-208-2 and 780-208-4.
